Welcome to the WARCODES application (the "App"). In our innovative mobile game, scanning barcodes unlocks an entire universe of creatures, each with its own characteristics, abilities, and appearance based on the product you scan. Once created, you can battle the creatures created by other registered users. The App also allows you to make in-App purchases of creature-related merchandise from third party vendors. Warcodes™, the d/b/a of Cozy Orchards, LLC ("we," "us," or "our") respects your privacy and that of your children, and we are committed to protecting that privacy through adherence to this Policy. This Policy describes the types of information that we do or may collect from you or your child, or that you or your child may provide when you download, register with, or use our App, and our practices for collecting, using, maintaining, protecting, and disclosing that information.
In the following pages, we explain how and when we collect information from or about you or your child, what we do with it, how we might share it, and your rights concerning our collection and use of such information. Please check back from time to time to ensure that you are familiar with the most up-to-date version of this Privacy Policy. By downloading the App and by creating an account with us for you or your child, you are agreeing to be bound by the Warcodes Terms of Use (the "Terms of Use"), and by the terms of this Privacy Policy (this "Policy") as it relates to our collection, possession, protection, use and sharing of certain information.
PLEASE REVIEW THIS POLICY CAREFULLY. We have attempted to provide clear explanations of our privacy practices and policies so that you can make meaningful decisions about whether to use or to allow your child to download and use the App. For your convenience, the Information is arranged in the following order:
This Policy applies to information that we collect:
We collect several types of information from and about users of our App, including:
Other information is collected from your or your child's use of the App without requiring any specific input from you or your child, and such other information, generally, does not specifically identify the App user. This information is or may be secured through the use of tracking "cookies" and similar technologies, such as "web beacons," designed to enable us to better understand users of the App, their needs and preferences, any setting options they may select and any other information about how they use the App. "Cookies" are, essentially, small text files that are stored on your computer and used by developers to help users enjoy the App and to facilitate the processing of certain functions. In addition to any cookies that we place on your device when you access the App, cookies may be created and stored on your device by any other websites that run advertisements or other elements on the pages of the App, or by third parties whose services we engage in connection with the App, such as companies that track or tabulate App visits, session length and provide traffic or additional user analytics.
We also may employ "web beacons" to collect information or to determine or confirm usage of the App. A "web beacon" (also known as clear GIFs, Web bugs or pixel tags), describes a tiny (often transparent or otherwise inconspicuous) file embedded on an App page to allow us or a third party engaged by us to track who is accessing the App, when, and from which device. The data obtained from the use of such technology allows us or our third party consultants or service providers to analyze usage and usage patterns, facilitating further development of the App in line with visitor preferences and usage.
Most device browsers allow users to modify their acceptance of cookies, by limiting cookies accepted to those from websites or Apps that you visit (as opposed to cookies from third parties placed through your visit to an app or a website), or even to reject all cookies. Rejecting all cookies may not be sufficient to eliminate all tracking or other technologies that are routinely used for collecting information, including web beacons. Unlike cookies, web beacons cannot be rejected and choosing to reject cookies does not eliminate web beacons.
If you wish to delete cookies or modify your acceptance of cookies, whether in connection with your use of the App or otherwise, you should check with the provider of your browser or your device's operating system to determine how to delete or reject cookies, and how to reset the settings that govern the acceptance or rejection of cookies. This information is typically found in Systems Settings, Preferences or Help settings.
Please note that rejecting cookies used by the App will affect your experience with the App and may prevent you from being able to fully access the App and/or from being able to enjoy the full user experience in the manner intended.
We use the information that we collect from or about you or your child, or that you provide or that your child provides to us to:
We may disclose aggregated (anonymized) information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect from you or from your use of the App, or that you provide as described in this Policy to:
We are committed to complying with the Children's Online Privacy Protection Act (COPPA) and other applicable laws concerning children's privacy. At present, we rely on the verification of the age of users by the App Store (such as Apple App Store and Google Play Store) through which the App is downloaded, and request verification of age in the process that we employ to set up an account.
Parental Rights: Parents have the right to review, delete, and manage their child's personal information. If you believe that we have collected personal information from a child under the age of 13 without parental consent, please contact us at support@warcodes.app, and we will take all reasonable steps to delete that information.
We may offer in-App purchases, and such offerings may change from time to time. If you or your child make purchases within the App, please note that all such transactions are handled by third-party app stores (such as Apple App Store, Google Play Store) and subject to their own terms and policies, for which we are not responsible. We do not store credit card or payment information.
You may have certain rights regarding the personal information we hold about you, including the right to access, correct, or delete your personal information, subject to certain exceptions. You can also opt-out of receiving marketing messages from us at any time by following the unsubscribe instructions included in our marketing communications.
PLEASE NOTE THAT CERTAIN STATES, currently including:
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia
have adopted State-specific data privacy laws already in force or soon coming into force that may provide you with additional rights concerning your personal information if you are a resident of one of such States. Similar laws are currently under consideration in other States and we will endeavor to keep this list updated to reflect such additional States.
Depending on your State of residence or location, you and your child may have certain rights (which may differ in some respects from State to State) regarding personal information, including:
If you are a resident of a country within the European Union, or Iceland, Liechtenstein or Norway (EEU but not EU Members) and register to use the App, your rights of privacy may differ under the EU's General Data Protection Regulation (the "GDPR") in certain material ways from privacy rights of U.S. residents under State-specific privacy laws in certain States. If you are a resident of the United Kingdom (following Brexit), your rights of privacy concerning your personal data are governed by the UK GDPR, incorporated into the Data Protection Act 2018, and substantially identical to the GDPR. Generally, privacy rights for those covered by the GDPR or the UK GDPR include:
Whether your privacy rights are covered by the GDPR, the UK GDPR, by a specific United States State data privacy law regime, or under this Policy only, you can exercise your rights at any time and from time to time by contacting us at support@warcodes.app. If your request is made under the GDPR because your privacy rights are governed by the GDPR, we have one month within which to respond to your request.
In the event of any conflict between applicable law and this Policy, we will follow applicable law as it applies to you and your rights under such law.
We prioritize the security of your data by employing industry-standard measures, including encryption, firewalls, secure transmission protocols, access controls and routine security audits to mitigate the risk of unauthorized access, use, alteration and disclosure, and reassess from time to time whether such measures are at least consistent with the measures employed by other similar App providers. At present, all personally identifiable information that we might obtain from a user and store as the result of a user's access to or use of the App is stored on servers located in the United States. Images created by App users located outside of the United States may be stored on servers in or closer to such users' locations outside of the United States. Despite our efforts to secure all data, please note that the transmission of information via the internet and mobile platforms is not completely secure, and we cannot and do not guarantee the security of your personal information transmitted through our App or stored by us.
Please note that, as a convenience to our App users, we may from time to time provide links to other apps, websites or webpages that may be of interest. We may add, remove or change any such links at any time and from time to time. We are not responsible for the content, terms of use or privacy practices of any such other apps, websites or webpages, even if links to them are provided in or through the App. If you choose to connect to any other app, website or webpage via links provided in or through the App, you do so at your own risk, and you should read and familiarize yourself with the privacy policies of such other app developers or website owners to determine how they collect and use personally identifiable information in connection with your downloading and use of their app, or in connection with your visit.
We may update our Policy from time to time. If we make material changes, we will notify you by an in-App alert or by email before the changes become effective, unless the implementation is in response to a change in applicable law of regulation or a security vulnerability where an immediate change is required or otherwise warranted.
To ask questions about or to comment on this Policy or our privacy practices in general, please contact us at: support@warcodes.app.
Please note that by accessing or using the App, you agree to the terms of this Privacy Policy. In the event that you do not agree to any term or aspect of this Policy, please immediately cease all use of the App.
